Hutelmyer v. Cox
133 N.C. App. 364, 514 S.E.2d 554 (N.C. Ct. App. 1999), disc. rev. denied, 351 N.C. 104
Facts. Married in 1978, the plaintiff described a “fairy tale marriage” through the early 1990s. Her husband’s secretary began traveling and working late with him, and a former neighbor and a coworker saw his car at her home at night. He left in January 1996.
Holding. A verdict of $500,000 compensatory and $500,000 punitive on both claims was upheld. The evidence of malice and causation was sufficient.
Why it matters. The first widely publicized $1 million North Carolina verdict. Coworker testimony and lost financial support mattered.
