Property and debt Retirement is often the largest marital asset and the one most likely to be divided on paper and never actually transferred. What part is even divisibleRetirement earned during the marriage and before the date of separation is marital property. A balance that existed before the wedding is separate, and so is the passive growth on that separate portion. The dividing line is almost always a tracing question, which means it is a documents question. The single most useful thing you can produce is a statement showing the balance on the date of marriage and a statement showing the balance on the date of separation.
The order is a separate documentThe most commonly dropped ball in a North Carolina divorceAn agreement that says the 401(k) shall be divided equally does not divide anything. An employer plan needs a qualified domestic relations order, drafted separately, entered by the court, and approved by the plan administrator. Agreements sit unexecuted for years because nobody said who would draft it. Name three things in the agreement: who drafts the order, who pays for it, and the deadline for entry. Valuing what you are tradingA dollar in a Roth is not a dollar in a traditional 401(k), because one has already been taxed and the other has not. Trading a pre-tax retirement balance against post-tax home equity without adjusting for that difference systematically favors one spouse. The same is true of a pension, whose present value depends on assumptions a plan statement does not show. Why a dollar is not always a dollarSurvivor benefits and beneficiariesFor a pension, survivor benefit elections matter enormously and often must be made within defined windows. For any account, beneficiary designations do not update themselves after a divorce, and a designation naming a former spouse can control regardless of what the divorce judgment says. Update every designation, and confirm it in writing. I have seen more money lost to an unexecuted QDRO than to any argument about who deserved what.Christopher Adkins, Adkins Law Frequently asked questionsHow is a 401(k) divided in a North Carolina divorce?Usually by a qualified domestic relations order, a separate order entered by the court and approved by the plan administrator. Is my pre-marital retirement balance safe? The balance that existed before the marriage, and its passive growth, is generally separate property, but it must be traced with documents. Is dividing retirement taxable?A properly executed QDRO or transfer incident to divorce is generally not a taxable event. Cashing out instead of transferring usually is. Do I need to change my beneficiary after divorce?Yes. Beneficiary designations do not update automatically and can control who receives the account regardless of the divorce judgment. Make sure the order actually gets enteredAdkins Law drafts and tracks the orders that move retirement money, so the division in your agreement becomes a division in your account.
