Custody One parent is arguing about who decides. The other is arguing about Wednesday. North Carolina treats those as two separate questions, and the labels matter less than the calendar. Two different argumentsMost custody conversations go badly because the two parents are arguing about different things without realizing it. One is talking about who decides where the child goes to school. The other is talking about who has the child on Wednesday. North Carolina treats those as separate questions. The two halves of custodyLegal custody in practiceJoint legal custody is common, and it means both parents must be consulted on major decisions. It works when parents can communicate. It fails, expensively, when they cannot, because a deadlock over a school or a therapist becomes a motion. The fix is not sole legal custody by default. It is a tie-breaker written into the order, ideally by subject: one parent decides education, the other decides non-emergency medical, or a named professional breaks ties. Anything is better than a deadlock with no exit. Physical custody is a schedule, not a labelThe words primary, joint, shared and visitation have no fixed legal meaning in a North Carolina custody order. What controls is the schedule written into the document. Two orders can use opposite labels and produce the same calendar, and two orders using the same label can produce very different lives. There is one place the label matters: child support. The shared custody worksheet applies when each parent has at least 123 overnights per year, so the schedule and the support number are negotiated together. Counting overnights, not labelsWords that cause trouble
Two parents can agree on the word joint and still disagree about every Wednesday for a decade. Write the calendar.Christopher Adkins, Adkins Law Frequently asked questionsWhat is the difference between legal and physical custody?Legal custody is authority over major decisions such as schooling and non-emergency medical care. Physical custody is where the child lives and the day-to-day schedule. Does joint custody mean equal time? Not necessarily. Joint legal custody concerns decisions. Time is set by the schedule written into the order. What happens if we deadlock on a decision?Without a tie-breaker in the order, the usual route is a motion. That is why a well-drafted order names who decides by subject. How do overnights affect child support? If each parent has at least 123 overnights per year, the shared custody worksheet applies, which usually lowers the transfer amount. Get the words right the first timeA custody order is only as good as its language. Adkins Law drafts orders that still work when the parents stop cooperating.
