Spousal support North Carolina has two spousal support claims that do different jobs on different timelines, and both start with the same question: is one spouse dependent? Two claims, two jobsNorth Carolina has two spousal support claims. Postseparation support is temporary, meant to bridge the gap between separation and the resolution of the alimony claim, and it is decided on a narrower record so it can move faster. Alimony is the longer-term award, decided on a fuller analysis. How the two claims differThe dependency testBoth claims start in the same place. A dependent spouse is one actually substantially dependent on the other for maintenance and support, or substantially in need of that support. A supporting spouse is the one upon whom the other is dependent. If neither spouse is dependent, there is no claim, regardless of the income gap. In practice this becomes two budgets: the reasonable monthly needs of the claiming spouse measured against the standard of living established during the marriage, set beside what is actually left in the other spouse’s budget after taxes, the mortgage and the children. How the analysis proceedsBuild the budget properly
The deadline that ends the claimBefore the divorce, alwaysClaims for postseparation support and alimony must be pending before the absolute divorce is granted. Two honest budgets narrow the range faster than two lawyers arguing about the standard of living.Christopher Adkins, Adkins Law Frequently asked questionsWhat is postseparation support?Temporary spousal support paid while the alimony claim is pending, decided on a narrower record so it can be resolved faster.
