Child support One number in the guidelines links the parenting calendar to the support figure. Here is how common schedules actually count. What the rule saysIf each parent has the child for at least 123 overnights per year, the shared custody worksheet applies. Below that threshold for one parent, the primary custody worksheet applies. The shared worksheet accounts for the fact that both households are carrying real costs, and it generally reduces the transfer amount. One hundred twenty-three overnights is roughly a third of the year. A standard every-other-weekend schedule falls well short. An equal schedule clears it comfortably. The interesting cases are in between. Every other weekend: about 52 overnights a yearEvery other weekend plus a midweek overnight: about 104Where the line gets crossedThe usual route past 123 is a combination: alternating weekends extended to Sunday evening or Monday morning, one or two midweek overnights, and a meaningful block of summer. Two or three weeks of uninterrupted summer time can be the difference. Count honestlyThe thing nobody should doDo not design a schedule to hit 123 overnights that you do not intend to exercise. Courts and the other parent notice, and a schedule that exists only on paper tends to unravel into a modification motion with an unsympathetic record. If you want more time, ask for it because you want the time. Negotiating schedule and support togetherBecause the threshold links the calendar to the money, these two issues cannot sensibly be negotiated apart. A parent who settles custody first and support second often finds the second negotiation already decided. The productive approach is to model both together: what does the schedule look like, what does the worksheet produce at that schedule, and is the result something both households can actually live on.
Approximate annual counts before holidays. The precise number depends on how the plan allocates holidays and summer, which is why they are counted too. The calendar and the support number are the same negotiation. Treating them as two conversations is how people end up unhappy with both.Christopher Adkins, Adkins Law Frequently asked questionsWhat is the 123 overnight rule?If each parent has at least 123 overnights per year, the shared custody worksheet B applies instead of worksheet A, which usually reduces the transfer amount. How many overnights is every other weekend?Roughly 52 per year before holidays and summer, which is below the threshold. Do holidays and summer count?Yes. Overnights are counted across the full year, including holiday and summer time. Can I ask for more time to lower support? You can ask for more time, and you should exercise it. A schedule designed only to change the number and not actually used tends to fail badly. Model the schedule and the number togetherAdkins Law can run the worksheet at several candidate schedules so you can see the real trade-off before you agree to either.
