Custody Temporary is a legal label, not a description of how long the schedule will govern your family. This is the hearing people under-prepare for. Why it matters more than it shouldA temporary custody order is meant to hold the line until the case can be heard fully. In practice, because final hearings can be months away, the temporary schedule becomes the child’s routine, and courts are reluctant to disrupt a routine that is working. The hearing that people under-prepare for is often the one that sets the shape of everything after it. What the hearing looks likeIt is shorter and more compressed than a full trial. Each side usually presents limited testimony and a small number of exhibits. Some courts limit the time available. The judge is trying to answer a narrow question: what arrangement is workable and safe right now. A temporary custody hearingWhat persuades at a temporary hearingPrepare for the narrow questionThe status quo argumentWhatever arrangement the family has fallen into since separation carries real weight, which is why the informal schedule set in the first weeks matters. If the current arrangement is not what you want long term, the time to address it is immediately, in writing, not six months later when it has become the routine. Living with a temporary orderFollow it exactly, even the parts you dislike. A parent who complies precisely while the other does not builds a record that matters at the final hearing. A parent who self-corrects by withholding time hands the other side the argument. Temporary orders are temporary in name. Prepare for that hearing as though it decides the next two years, because it often does.Christopher Adkins, Adkins Law Frequently asked questionsHow long does a temporary custody order last?Until it is modified or replaced by a permanent order, which can be many months depending on the county calendar. Can a temporary order be changed?Yes, by agreement or by motion, though courts are reluctant to disturb a routine that is working for a child. What should I bring to a temporary hearing?A specific proposed schedule, your actual work schedule, documentation of your involvement in school and medical care, and a short dated log. Do I have to follow an order I think is wrong?Yes. Comply exactly and address it through proper channels. Self-help damages your position badly. Prepare for the hearing that sets the patternAdkins Law prepares temporary custody hearings with the narrow question in mind: what schedule works, and can you prove you can keep it.
