Divorce and separation One date fixes every property value, starts the divorce clock, and divides conduct into before and after. Most couples never write it down. What the date actually isIn North Carolina you are separated when you and your spouse begin living in separate residences and at least one of you intends the separation to be permanent. Both elements matter. Separate bedrooms in the same house do not count, and a trial separation where both people expect to reconcile may not either. There is no form to file and no court to notify. The date simply is what it is, which is precisely why it becomes a fight later. Four things it decidesWhat the date of separation controlsValues freeze on that dayMarital property is valued as of the date of separation, not the day of the hearing. A retirement account that grew afterward, a house that appreciated during a hot Charlotte market, a truck that lost value: the marital share is measured on the separation date, and the change afterward is handled as divisible property. This is why the single most useful thing you can do in the first week is download a statement for every account covering the separation month. Those documents get harder to obtain as time passes, especially for accounts in the other spouse’s name. Before and afterMarital misconduct that affects alimony is measured against the date of separation. Illicit sexual behavior by the dependent spouse before that date bars alimony. The same conduct by the supporting spouse before that date requires an award. Conduct after the date of separation is treated differently, although a court can still consider post-separation conduct that corroborates pre-separation behavior. People hear that and conclude the date is a green light. It is not. The line is contested constantly, and a disputed separation date turns a support case into a credibility trial. Two people rarely disagree about whether they separated. They disagree about when, and it is almost always because nobody wrote it down.Christopher Adkins, Adkins Law How to establish the date
Reconciliation restarts itResuming the marital relationship can restart the one-year clock and can affect a separation agreement, with different consequences for terms already performed and terms not yet performed. Isolated contact is generally not reconciliation, but a pattern of resuming the relationship can be. If there is any chance of reconciling, get advice about the effect on an existing agreement before you do it. Frequently asked questionsDoes sleeping in separate bedrooms count? No. North Carolina requires separate residences, not separate rooms. What if we disagree about the date?It becomes a contested issue of fact, decided on evidence. Contemporaneous documents beat testimony every time. Can we agree on a date in writing?Yes, and you should. A separation agreement or a simple signed acknowledgment reciting the date removes the dispute. Does a short reconciliation reset the clock? It can. Resuming the marital relationship affects both the one-year period and an existing agreement, so get advice first. Confirm your date before it becomes an argumentEstablishing the separation date early is inexpensive. Litigating it two years later is not.
