Custody There is no mileage rule in North Carolina. A move turns a working schedule into an open question, and how you raise it matters as much as why. There is no mileage ruleNorth Carolina has no statute saying a parent may move a certain distance. A request to relocate with a child is decided on the best interests of the child, and where an order is already in place, the parent seeking the change must first show a substantial change in circumstances affecting the welfare of the child. Distance alone is not automatically that change, and it is not automatically a bar. Courts look at the reason for the move, whether it improves the child’s life, the effect on the relationship with the other parent, whether a realistic schedule can preserve that relationship, and each parent’s willingness to support contact. Why these settle better than they tryA relocation hearing produces a winner and a loser, and the loser lives with it every week for years. In mediation the question changes from whether the move is permitted to what a workable plan looks like if it happens. That reframing regularly produces a package neither parent would have proposed: a longer summer block, all school breaks, travel costs allocated by income, and a guaranteed number of in-person weekends. Handling a proposed relocationWhat a distance schedule looks like
Travel is a term, not an afterthoughtLong-distance plans fail on logistics rather than principle. The agreement should name who books travel, who pays and in what share, where the exchange happens, what happens when a flight is cancelled, and how unaccompanied minor fees are handled. Virtual contact deserves the same specificity: a scheduled call two or three evenings a week at a set time, with the receiving parent responsible for making the child available. Which state decidesNorth Carolina follows the Uniform Child Custody Jurisdiction and Enforcement Act. In general the home state — where the child lived for the six months before the case began — makes the initial custody determination, and the state that entered the order keeps exclusive continuing jurisdiction while a parent or the child remains connected to it. A mediated agreement should acknowledge which court will hear any future dispute. Notice first, plan second, motion last. Parents who reverse that order spend a great deal more money.Christopher Adkins, Adkins Law Frequently asked questionsHow far can I move with my child in North Carolina? There is no set distance. Where an order exists, a move that changes the schedule generally requires agreement or a modification based on the best interests of the child. Do I have to give notice before moving? Many orders contain a written notice provision. If yours is silent, notice is still the safer course and it preserves your credibility. Who pays for travel? It is negotiated. Allocation by relative income is common, as is splitting costs with the relocating parent covering the larger share initially. What if the other parent will not discuss it?Mediation is still available, including in separate rooms or online. If it does not resolve, the question goes to the district court. Raise the move the right wayHow a relocation is first raised shapes everything that follows. Talk to Adkins Law before the moving truck is booked, or as soon as you receive notice.
