Property and debt Debt is divided the same way assets are, and the name on the account matters far less than people expect. What matters more is who the lender can still chase. Debt is classified exactly like assetsPeople assume debt follows the name on the account. It does not. A debt incurred during the marriage and before separation for the joint benefit of the marriage is marital debt, whether it is in one name or both. A debt one spouse ran up before the wedding, or after separation, is generally that spouse’s separate debt. How marital debt is sortedYour agreement does not bind the lenderThe point that costs people the mostA separation agreement or court order can say which spouse is responsible for a joint debt. It cannot change the contract with the creditor. If your name is on the account and the other spouse stops paying, the lender will pursue you and the late payment will land on your credit report. The remedy is indemnification — a clause requiring the responsible spouse to reimburse you, including attorney fees, if you are pursued. That is worth having, but it is a lawsuit, not a shield. Closing or refinancing joint accounts is the real protection. Protecting yourself in practice
Common debts and how they usually landHow different debts tend to be treatedWaste of marital assets — spending money on an affair, gambling, or deliberately dissipating funds — is one of the distributional factors a court may consider in dividing property and debt unequally. An indemnification clause is a promise. A refinance is a solution.
